Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Skim or Dive app and website (the “Service”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Who can use the Service

You must be at least 13 years old (or the minimum age of digital consent in your country) to use Skim or Dive. By using the Service you represent that you meet this requirement and that the information you provide is accurate.

2. Your account

You are responsible for activity under your account and for keeping your credentials secure. Notify us promptly of any unauthorized use. You may delete your account at any time from within the app.

3. Content you upload — ownership warranty

Skim or Dive lets you import ebooks and text files for your own personal reading. You represent and warrant that you own, or have the legal right to use, every file you upload, and that uploading it and having it processed by the Service does not infringe anyone’s copyright or other rights.

• You retain all rights you hold in the content you upload.
• You grant us a limited licence to store and process that content solely to provide the Service to you (for example, to display it, generate detail levels, and create continuations). We do not use it to train AI models and we do not make it available to other users.
• You are solely responsible for the content you upload. You agree to indemnify and hold Skim or Dive harmless from any claim arising out of content you upload in breach of these Terms.

4. AI-generated content

The Service uses artificial intelligence to produce condensed/expanded detail levels and chapter continuations from your books. AI output can be inaccurate, incomplete, or inconsistent with the source text, and may not reflect the author’s intent. Generated content is provided for your personal enjoyment “as is” and should not be relied upon as an accurate representation of the original work. Continuations are derivative of the source material you provide; you are responsible for ensuring your use of them is lawful.

5. Acceptable use

You agree not to:

• upload content you do not have the right to use;
• use the Service to infringe intellectual-property or privacy rights;
• attempt to access other users’ accounts or data;
• reverse engineer, overload, or disrupt the Service or its infrastructure;
• resell or redistribute generated content in violation of the source work’s rights;
• use the Service for any unlawful purpose.

6. Copyright complaints (DMCA)

We respect intellectual-property rights and respond to valid notices of alleged infringement. If you believe content processed through the Service infringes your copyright, send a notice to legal@skimordive.com including: a description of the work, the material at issue, your contact information, a statement of good-faith belief that the use is unauthorized, and a statement under penalty of perjury that your notice is accurate and that you are the rights holder or authorized to act on their behalf. We will remove infringing material and may terminate accounts of repeat infringers.

7. Payments

Some features may require payment or a subscription. Purchases made through the Apple App Store or Google Play are processed by those platforms and subject to their terms; refunds and cancellations are handled according to their policies. We will describe prices and what each plan includes before you purchase.

8. Service availability and changes

We may modify, suspend, or discontinue any part of the Service at any time. We try to keep the Service available but do not guarantee uninterrupted access.

9. Disclaimers

The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.

10. Limitation of liability

To the fullest extent permitted by law, Skim or Dive will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the 12 months before the claim.

11. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you breach these Terms or use the Service in a way that risks harm to others or to the Service.

12. Governing law

These Terms are governed by the laws of Australia, without regard to conflict-of-laws rules. The courts of Australia will have non-exclusive jurisdiction over any dispute. Nothing in these Terms limits your rights under the Australian Consumer Law or any other consumer-protection law that applies to you, including your right to bring proceedings in the country or state where you live.

13. Changes to these Terms

We may update these Terms from time to time. We will post the updated version here and revise the “Last updated” date. Continued use of the Service after changes take effect means you accept the revised Terms.
